General Terms and Conditions

The following is a translation of the Terms and Condition for your convenience. Accuracy cannot be guaranteed. Only the German version is legally binding.

  1. Availability of the legal representative:
    The legal representative of the participating child is obliged to provide a current telephone number upon registration at which the legal representative can always be reached.

  2. Supervisors:
    The supervisors employed by the organiser are predominantly native English speakers. These supervisors may be fully bilingual (German/English), but there may also be supervisors who speak little or no German.

  3. Insurance:
    The organiser takes out organiser’s liability insurance for camps. The legal representative of the participating child is obliged to ensure that the participating child has health insurance that is also valid at the location of the respective camp. Furthermore, it is recommended that the legal representative of the child take out liability and accident insurance for the participating child.

  4. Liability:
    The participating child and/or their legal representative are fully liable for any damage caused by the participating child during the camp, regardless of fault. The organiser is hereby released from any claims by third parties. The organiser accepts no liability for claims for damages by participants or third parties. The organiser’s liability for property damage is limited to three times the participation fee, provided that the organiser or the persons commissioned by the organiser to provide services on site did not cause the damage intentionally or through gross negligence. The organiser accepts no liability for the loss of or damage to valuables brought along. The organiser expressly points out that no valuables should be brought along. The organiser accepts no liability for the loss of or damage to smartphones, mobile phones or other mobile devices for electronic data processing; it expressly points out that the legal representative of the participating child must ensure that the participating child keeps any smartphone, mobile phone or other mobile data processing device brought along with them with them at all times during the camp, so that it is as secure as possible against loss and damage.

  5. Withdrawal of the participant and cancellation fees:
    The legal representative of the participating child is entitled to withdraw from registration for a camp. Withdrawal from registration must be made in writing. In all cases, a processing fee of 10% of the invoice amount will be charged for processing the withdrawal. In addition, 15% of the participation fee will be charged if the withdrawal is made less than 4 weeks before the start of the camp and 30% of the participation fee if the withdrawal is made less than 2 weeks before the start of the camp. Withdrawal is not possible after the start of the camp.

  6. Cancellation by the organiser:
    The organiser is entitled to cancel a camp event. This is primarily the case if the minimum number of participants required for the camp is not reached or if there are other important reasons for cancellation. In the event of cancellation, an attempt will be made to offer an alternative date or location. If it is not possible to find an alternative date or location, or if this is not accepted by the legal representative of the participating child, the participation fee already paid will be refunded in full. The participating child or their legal representative shall have no further claims against the organiser.

  7. Premature termination:
    The organiser reserves the right to terminate a camp event prematurely. Premature termination by the organiser may occur due to force majeure or other important reasons that prevent the camp event from continuing in an orderly manner. In such cases, the full participation fee will be retained. There shall be no further claims against the organiser. The organiser also reserves the right to exclude individual participating children who do not comply with the camp rules set by the organiser, who disobey the instructions of the supervisory team or whose behaviour has a persistently negative effect on the group, without reimbursement of costs. Any additional costs, in particular travel costs for returning home, shall be borne by the legal representative of the participating child.
    The conceptual design, in particular the (language) teaching and didactic methods, as well as the specific schedule and implementation of the camp, shall be carried out in accordance with the standard developed by the organiser for this purpose. This standard also includes ancillary services such as the supervision of the participating children. The organiser is not obliged to achieve a specific result. In the event that a legal representative of a participating child becomes aware of any shortcomings during the camp, the legal representative should contact the camp’s supervisory team or the organiser immediately. The organiser and the on-site support team are obliged to investigate such reports immediately and, if a deficiency is found, to remedy it within a reasonable period of time using appropriate means. If no property damage has been caused by such deficiencies, the organiser shall not be liable; in the event of property damage, clause 8 shall apply.

  8. Use of image and video material:
    The child’s legal representative agrees that all image and video material, including camp stories, drawings, etc., may be used by the organiser for commercial purposes. In doing so, the organiser shall ensure that no data/information (such as surnames, addresses, etc.) of the participating children is passed on/published. With regard to the dissemination of data (photos, videos, addresses, other data) by the participating children themselves or by their legal representatives or by other persons/third parties, the organiser expressly points out that it is not responsible for such dissemination/publication of data and is not liable for any damage/disadvantages caused thereby. Personal data of the legal representative and the child they represent will be treated confidentially and used for internal purposes only.

  9. Applicable law and place of jurisdiction:
    German law applies.

  10. Miscellaneous:
    Should any of the above provisions violate applicable law, all other provisions shall remain valid. The parties undertake to agree on a valid provision to replace the invalid provision, which comes closest to the purpose pursued by the invalid provision. The General Terms and Conditions apply to all contracts concluded after 1 January 2015.
